Decree No. 214/2025/ND-CP establishes specific legal frameworks for the bidding price determination process. In particular, for procurement packages involving pharmaceuticals, chemicals, diagnostic materials, and medical equipment, compliance with quotation collection regulations is mandatory to ensure transparency and fairness in bidding.

Many entities, including food safety testing agencies under the Ministry of Health, have questioned whether the obligation to post quotation requests on the National Bidding Network System applies to them or is exclusive to hospitals and clinical care providers.

In response, the Ministry of Finance confirms that according to Clause 2, Article 18 of Decree No. 214/2025/ND-CP, when a project owner chooses the price quotation method to determine the package price for the aforementioned medical categories, they are required to post the quotation request on the National Bidding Network System.

This regulation is applied uniformly to all project owners, regardless of whether the entity has functions directly related to clinical examination and treatment. The objective is to foster competition and standardize input data for package pricing.

In addition to the mandatory posting on the National Bidding Network System, the Ministry of Finance encourages entities to publish information on their own websites, the Ministry of Health's web portal, or the Public Service Portal for medical equipment management.

Interested contractors should note that the deadline for submitting quotations is a minimum of 10 days from the date the request is posted. In cases where there are two or more quotations, the project owner is permitted to select the highest quotation that fits their financial capacity and technical requirements.

Important note: If the project owner does not utilize the price quotation method to determine the package price, they are not bound by the obligation to post a request for quotation notice. This allows project owners greater flexibility in procurement planning depending on the nature of each package.
