Continued Application of Decree 15/2018/ND-CP on Food Safety Pending New Regulations
The Government has decided to suspend certain new decrees and maintain Decree 15/2018/ND-CP to ensure stability in food safety management.

The Government has issued Resolution No. 15/2026/NQ-CP dated April 6, 2026, officially suspending the validity of Decree No. 46/2026/ND-CP and Resolution No. 66.13/2026/NQ-CP. This decision aims to provide a necessary transition period until the amended Law on Food Safety and its guiding documents officially come into effect.

During the suspension period, Decree No. 15/2018/ND-CP dated February 2, 2018, detailing the implementation of several articles of the Law on Food Safety, will remain the primary regulatory framework. The Government has directed specialized Ministries, including the Ministry of Health, the Ministry of Industry and Trade, and the Ministry of Agriculture and Rural Development, to proactively review and amend National Technical Regulations (QCVN) and professional guidelines to align with practical management requirements.

Regarding oversight, the Ministry of Health is tasked with strictly monitoring advertising and product self-declaration, particularly concerning health supplements. The Ministry of Industry and Trade will focus on addressing trade fraud, counterfeit goods, and smuggled items on e-commerce platforms. The Ministry of Science and Technology is responsible for enhancing the management of testing laboratory accreditation and standardizing National Standards (TCVN).

At the local level, People's Committees of provinces and cities are required to strengthen inspections and monitoring, with a specific focus on preventing food poisoning in collective kitchens, school canteens, and street food vendors. Local authorities must publicly disclose information regarding testing and certification organizations in accordance with Decree No. 22/2026/ND-CP.

The Government is also promoting the connection and sharing of food safety data on the National Public Service Portal, unifying the management system from central to local levels, and encouraging the application of artificial intelligence in product control. For dossiers submitted prior to the effective date of this Resolution, competent authorities will continue to process them based on the provisions of Decree 15/2018/ND-CP.

Resolution No. 15/2026/NQ-CP takes effect from April 6, 2026, and replaces Resolution No. 09/2026/NQ-CP, reaffirming the Government's commitment to maintaining order and food safety during this policy transformation period.
